Accomplished WV Injury Attorney Seeks Compensation for CPAP-Caused Illnesses

Morgantown mass tort lawyer fights for those affected by defective Philips Respironics CPAP machines

Around 8 million Americans use CPAP machines to help them get a good night’s sleep and avoid the debilitating health effects of sleep apnea. A regulated airflow with consistent pressure assists in keeping the airways open, so CPAP users don’t struggle to breathe while sleeping. Unfortunately, for many users, the machines were funneling contaminated air into their lungs and causing far worse health problems than their apnea. One CPAP manufacturer in particular, Philips Respironics, stands accused of producing defective and dangerous machines that harmed consumers. At Mountaineer Injury Law Group in Morgantown and Martinsburg, I am an accomplished West Virginia product liability attorney who stands up for injured CPAP users. If you have suffered an illness due to a defective Philips Respironics machine, my firm can help you pursue justice.

Understanding the Philips Respironics lawsuit

In June 2021, noting that deteriorating foam in Philips Respironics CPAP machines posed a serious health risk to consumers, the Food and Drug Administration issued a mandatory recall of BiPAP devices and ventilators made since 2009. The company, which apparently was aware of problems beginning in 2015, recalled about 5 million devices.

In recent years, the defects have been linked to health problems, such as respiratory illness, lung cancer in thousands of users and as many as 385 deaths. Injured consumers have filed numerous class actions against Philips Respironics for injuries that occurred when the machines blew toxic gases and flecks of foam into their mouths and lungs.

Then, in September 2023, Philips Respironics agreed to a $479 million partial settlement for the victims of its defective CPAP machines. Given the huge number of claimants, this settlement is only adequate to address the product failure, with a $100 premium added for each device returned to Philips. This does not provide compensation for the serious medical conditions CPAP users have suffered, but it does acknowledge problems with the devices, which strengthens the case for injury compensation.

Eligibility for a Philips Respironics personal injury claim

Now is the time to consult a knowledgeable product liability attorney and file a personal injury claim against Philips Respironics if you believe you were harmed. Numerous class actions are being litigated, and the company will be pressured to settle. You can join in a class action if you used a Philips device affected by the recall and were potentially exposed the toxins in the deteriorating foam that have been linked to serious medical problems such as:

  • Cancer
  • Acute respiratory distress system (ARDS)
  • COPD
  • Kidney disease
  • Lung disease
  • Liver disease
  • Pleural effusion
  • Pneumonitis
  • Reactive airway disease (RAD)
  • Respiratory failure

I have extensive experience obtaining substantial compensation for plaintiffs in mass tort cases against corporate defendants. My firm can advise you about your eligibility and explain how to pursue a claim. Given the large number of victims, you want your claim to be heard as quickly as possible so you can receive an award or settlement in a timely manner.
