Understanding the Philips Respironics lawsuit    

In June 2021, noting that deteriorating foam in Philips Respironics CPAP machines posed a serious health risk to consumers, the Food and Drug Administration issued a mandatory recall of BiPAP devices and ventilators made since 2009. The company, which apparently was aware of problems beginning in 2015, recalled about 5 million devices.

In recent years, the defects have been linked to health problems, such as respiratory illness, lung cancer in thousands of users and as many as 385 deaths. Injured consumers have filed numerous class actions against Philips Respironics for injuries that occurred when the machines blew toxic gases and flecks of foam into their mouths and lungs.

Then, in September 2023, Philips Respironics agreed to a $479 million partial settlement for the victims of its defective CPAP machines. Given the huge number of claimants, this settlement is only adequate to address the product failure, with a $100 premium added for each device returned to Philips. This does not provide compensation for the serious medical conditions CPAP users have suffered, but it does acknowledge problems with the devices, which strengthens the case for injury compensation.
